Article 1: Definitions

Education:

Education, training, workshop, course and/or instruction, including both distance learning and in-person education.

Client:

Individuals and organizations that have purchased education from Enhancing Trauma Treatment Institute B.V.

Agreement:

An agreement as referred to in Article 2 paragraph 1.

Distance Agreement:

An agreement concluded exclusively through one or more means of distance communication, such as written correspondence or digital communication.

Enhancing Trauma Treatment Institute B.V.:

Enhancing Trauma Treatment Institute B.V., established in Utrecht, registered with the Chamber of Commerce under number 82335826, and owner of www.enhancingtraumatreatment.com and all associated copyrights.


Article 2: Applicability

  1. These Terms and Conditions apply to all agreements concluded with Enhancing Trauma Treatment Institute B.V. The applicability of any general terms and conditions of the Client, by whatever name, is expressly rejected.
  2. Deviations from these Terms and Conditions shall only be binding if and insofar as agreed in writing between the Parties.

Article 3A: Access to Digital Content

  1. Access to digital course materials, online learning environments, and webinar recordings is granted for a period of 90 days from the date of purchase, unless explicitly stated otherwise in writing.
  2. Upon expiration of this period, access shall automatically terminate without any entitlement to compensation or refund.
  3. Access to digital content is personal, non-transferable, and may not be shared with third parties. The Client is responsible for safeguarding login credentials.
  4. Where digital content is made available immediately after purchase, the Client expressly agrees that performance of the agreement begins immediately and acknowledges that the statutory right of withdrawal may lapse once access has been granted.

Article 3B: Offer

  1. Enhancing Trauma Treatment Institute B.V. shall present its offer digitally or in writing.
  2. The offer shall contain a complete and accurate description of the education and/or teaching materials that form part of the education. The offer shall also indicate whether use of such materials is mandatory.
  3. The offer shall at least include the following information:

    - the method of delivery or execution of the agreement;
    - the starting date of the education;
    - the conditions under which the education may be cancelled;
    - where applicable: admission requirements;
    - the price, including all additional costs and taxes;
    - the method of payment;
    - the duration of the agreement.

  4. These Terms and Conditions shall be made available to the Client prior to concluding the agreement and form an integral part of the general information provided by Enhancing Trauma Treatment Institute B.V.
  5. Enhancing Trauma Treatment Institute B.V. may require, as a condition for issuing an offer and/or accepting an order, that the Client provides personal data and/or a copy of a valid passport or identity card.
  6. Without prejudice to paragraphs 1–5, in the case of a distance agreement, the offer shall additionally include:

    - the identity and postal address of Enhancing Trauma Treatment Institute B.V.;
    - the Client’s right to withdraw within fourteen days in accordance with Article 6 paragraphs 2 and 3;
    - where additional costs apply for telephone or internet contact: the applicable rates;
    - the period for which the offer remains valid.


Article 4: Agreement

  1. The agreement is concluded upon acceptance of the offer by the Client. After conclusion, the Client shall receive confirmation in writing or digitally.
  2. In case of digital registration, Enhancing Trauma Treatment Institute B.V. shall send digital confirmation. Until receipt of confirmation, the Client may cancel the order.
  3. After conclusion of a distance agreement, the information referred to in Article 3 paragraphs 3 and 6 shall be provided in writing or on another durable medium accessible to the Client.

Article 5.1: Cancellation or Modification by Enhancing Trauma Treatment Institute B.V.

Enhancing Trauma Treatment Institute B.V. reserves the right to cancel a training or assignment without stating reasons or to refuse participation. In such cases, the Client is entitled to a full refund of the amount paid.


Article 5.2: Cancellation by the Client

If the agreement concerns in-person education with a fixed start date, the following cancellation policy applies after the reflection period:

a. Cancellation prior to commencement:

  • Cancellation up to four weeks before the start date: 100% refund.
  • Cancellation between two and four weeks before the start date: 50% refund.
  • Less than 2 weeks before the workshop start date: No refund will be issued.
  • Not showing up for the workshop means you forfeit your payment and are not eligible for a refund.
  • Once the course materials have been received, cancellation is no longer possible.
  • Rebooking is always possible, provided the workshop has not yet started. A rebooking fee applies at all times. Rebooking to a next edition is only possible as long as the workshop remains in our current program. If the workshop is no longer offered, participants may, upon payment of a rebooking fee, convert the paid workshop fee into credit for another workshop, training or consultation.

Article 6: Termination of the Agreement

  1. The Client may terminate a fixed-term agreement at any time.
  2. Interim termination does not entitle the Client to a refund, except for teaching materials not yet delivered.
  3. For distance agreements, the Client has the right to withdraw within fourteen days without giving reasons. If required information was not provided, this period extends up to a maximum of three months.
  4. In case of lawful withdrawal, the Client is entitled to a refund within 30 days.
  5. Teaching materials must be returned at the Client’s expense and risk.
  6. Any supplementary payment arrangement is automatically dissolved upon withdrawal.
  7. No right of withdrawal exists once the education has commenced with the Client’s consent before the withdrawal period has expired. Commencement includes granting access to digital materials.

Article 7: Prices and Price Changes

Prices are non-binding unless included in a written agreement. Current prices are listed on www.enhancingtraumatreatment.com.

  1. Price changes within three months of conclusion of the agreement and before commencement shall not affect the agreed price.
  2. If the price increases after three months but before commencement, the Client may terminate the agreement.
  3. Paragraphs 1 and 2 do not apply to statutory price changes.

Article 8: Conformity

  1. The education must conform to the agreement and be delivered professionally using proper facilities.
  2. Teaching materials must conform to the agreement and be suitable for normal use and any specifically agreed purpose.

Article 9: Payment

  1. Fees are invoiced or confirmed via automated payment confirmation. Payment must be made at the time of purchase or via recognized digital payment systems.
  2. If payment in installments is agreed, payment must follow agreed terms.
  3. Payment must be completed before commencement of the education. Full payment may be required no later than 10 days prior to start.
  4. Teaching materials purchased separately must be paid upon delivery.
  5. Refunds are processed within 30 days.

Article 10: Late Payment

  1. In case of late payment, statutory interest and collection costs may be charged without notice of default.
  2. Enhancing Trauma Treatment Institute B.V. may suspend performance and deny participation.
  3. During complaint handling (Article 14), interest and collection costs are suspended.

Article 11: Non-performance

  1. A party may suspend obligations if the other party fails to perform.
  2. Enhancing Trauma Treatment Institute B.V. has a right of retention.
  3. The agreement may be terminated unless the breach is minor.
  4. Force majeure (including illness, strikes, war, disasters, fire, government measures) excludes liability. Parties will seek a suitable solution; otherwise, the agreement may be terminated.

Article 12: Liability

  1. Liability for direct damage (excluding personal injury or property damage) is limited.
  2. Liability for personal injury or property damage is not excluded.
  3. This liability extends to employees and contractors.

Article 13: Confidentiality

  1. Information provided by Clients shall be treated confidentially. Enhancing Trauma Treatment Institute B.V. complies with applicable privacy laws.
  2. Name and address details are used to inform Clients about training. Opt-out requests are respected immediately.

Article 14: Questions and Complaints

  1. Administrative or content-related questions are answered within 10 days.
  2. Complaints must be submitted in a timely and clear manner, within one month of discovery.
  3. Unresolved complaints may be submitted to a court.

Article 15: Copyright and Intellectual Property

  1. Copyright and other intellectual property rights relating to education and materials remain the property of Enhancing Trauma Treatment Institute B.V. and/or its instructors.
  2. Without prior written consent, participants may not reproduce, sell, or share course materials.

Article 16: Amendments

Enhancing Trauma Treatment Institute B.V. reserves the right to amend these Terms and Conditions. New versions take effect immediately upon publication on the website.
